The President of the employment tribunals in England and Wales and the President of the Scottish employment tribunals have issued joint guidance on revised compensation awards for injury to feelings in discrimination claims. Employment tribunals are expected to decide discrimination claims within these guidelines.
For claims presented on or after 6 April 2019, the revised bands are:
• a lower band of £900 to £8,800 (for less serious cases);
• a middle band of £8,800 to £26,300 (for cases that do not merit an award in the upper band);
• an upper band of £26,300 to £44,000 (for the most serious cases), and
• the most exceptional cases capable of exceeding £44,000.
These bands are adjusted to take into account inflation and are expected to increase annually. In addition to the above awards, employees can also claim financial losses in discrimination claims. As the costs of getting it wrong can be substantial, employers should take care and seek timely advice.
